Housing Developers Should Offer Compensation [17th Sep 2012]
It has been suggested that housing developers may be encouraged to offer compensation to neighbours of land where they want building consent now that planning laws have been relaxed. A recent report from the government has suggested that builders may be able to build on areas outside of normal planning if they had local support for the scheme. It has been suggested that this policy could lead to compensation being paid to locals in the form of cash or local parks and amenities. The government say that the aim is to prevent the stockpiling of land by developers, who are hampered by council planning laws when they want to build. The government has also refused to say that they will oppose building on green belt land. It is also possible that compensation will be sought following the publication of the photos. It has been argued that the publication broke French privacy laws, which are harsher than in the UK. The photos were taken at a French château owned by Viscount Linley which is on private land. It is thought that the Royals are taking this action to prevent similar incidents happening in the future. It is thought that there are a total of 200 photos which could be published in a 26 page spread by an Italian magazine. The magazine is owned by Silvio Berlusconi although it has been stated that he does not make editorial decisions. The FSA set up a compensation scheme in June which included Barclays, Lloyds, HSBC and RBS and this scheme was then joined by other smaller banks. It has also been revealed that Barclays have put together a team of more than 500 staff and contractors to deal with the customers involved. However Mr Bebb says that some lenders seem to be putting off doing the set up work required to operate the compensation scheme and this could set back the rest of the banks involved. The main banks involved have stated that they did not expect the amounts of compensation to be excessive. Paul Eames was employed by Hepworth Building products and was exposed to epoxy resins while doing his job. Eames' union stepped in to claim the compensation for him and stated that he developed dermatitis which has caused pain and swelling of his arm. He was unable to work after the symptoms began and has filled out occupational health forms to highlight his condition. However he was put back on the same job and his arm again swelled and he broke out in blisters on his arms, hand and face. It wasn't until Eames started his case against his employers that he was placed into a role where he was not exposed to the chemical. The company has not admitted liability but paid £5,000 in settlement. Related Stories: Union helps man win compensation claim against firm - www.burtonmail.co.uk |
