Scottish Legal Complaints Commission (SLCC)
The Scottish Legal Complaints Commission or SLCC (www.scottishlegalcomplaints.com) was established in 2008 as a single place to go to for complaints about the legal profession. It is an independent body which is not associated in any way with government. They are not funded by the public, but from a levy charged to the legal profession and collected by the Law Society of Scotland. The SLCC decides whether to investigate complaints they have received regarding the service offered by a legal firm or individual where the firm has been unable to resolve the complaint themselves. If they see fit, the SLCC can put in place new procedure to prevent problems happening in the future and they may monitor firms in the short term. The SLCC can make a compensation award of up to £20,000 for loss, inconvenience or distress from the unprofessional conduct of any legal professional. They can also insist that work is redone or mistakes rectified. It has recently been suggested that the system employed by the SLCC is too complex and is not performing in the interests of the public. The former chief executive of the service has said that efficiency within the service and the legislation surrounding it is making it too difficult to carry out effective complaints procedures. In particular the way that complaints are judged before they are accepted is too complicated and often certain issues must be referred back to the Law Society or another professional body. This refers to conduct issues which are not the responsibility of the SLCC. |
