Claiming for Injuries Resulting from Car Accidents
If you are involved in a car accident it is easy to forget all of the important things you need to do both at the scene of the accident and afterwards. From informing your insurer to making sure you claim the compensation you are entitled to, the steps you need to take can be easy to forget. Your first concern may, quite rightly, be to ensure that any injuries are taken care of and to deal with the practicalities of getting your car repaired and getting back on the road as soon as possible. However if your accident was not your fault, you may decide to claim for compensation and if this is the case there are more things you need to bear in mind. Responsibility Working out who was responsible for your accident is one of the first things which will be taken into account when your claim is looked at. Your insurance company may have already investigated this and come to their conclusion. However, anything you can do to help them with this process the better. This may include taking photos and writing out a detailed version of exactly what happened. Try to get a witness report from someone who saw what happened. Bear in mind that the other driver is likely to be doing the same. Do the right thing Make sure that you act in a responsible manner at the scene of the accident. Anything you do which casts doubt on your credibility will not be looked on favourably. So you should always comply with the wishes of the police and ambulance crew if they attend and to provide details to the other driver if required. Visit your doctor Even if your injuries seem slight at the time of your car accident, you should still seek the advice of your doctor to check nothing more serious has happened. Soft tissue injuries such as whiplash tend to take a few hours or even days to show themselves completely. If you decide to proceed with a claim you need to show your injuries are genuine and the best way to do this is to visit your doctor or an emergency department. Claiming compensation for the car accident If you are injured in your car accident, the claiming process can be quite straightforward and is best carried out with the help of a claims company. Clearly this can only happen if the accident was not your fault. Even if you were not injured, you may have the right to claim for damage to your car from the person responsible. This is particularly helpful if you only have limited insurance cover and it will not cover you for car damage. If you decide the pursue the other person for uninsured losses, you will need to take the case to the small claims court. Usually this will be for damages of less than £5,000 and you may be able to get some help with your legal costs. The road condition If your accident was caused by damage to the road surface or from pot holes, icy roads or road works, you may be able to claim compensation for the accident from the local authority. It is their responsibility to keep the roads clear of obstacles or to warn about hazards. If this has not been done you may have a claim. You will need to show evidence that the road had not been inspected and repaired. You should take photos of the road and the damage done you your car plus provide evidence of how much you will need to spend to fix the car damage. There are claims companies online who will help with these types of car accident claims. |
