UK Excessive Whiplash Injury Claims Need to Stop says ABI [26th Apr 2012]
The Association of British Insurers (ABI) has stated that people should not be able to claim compensation for whiplash unless objective evidence can be given that an injury has been caused. Furthermore they have said that the cost of insurance is now being pushed up by and average of 20% due to these types of claims. Every year 570,000 people claim for whiplash injuries and the insurance industry paid out more than £2 billion last year. It is thought that £90 is added to insurance premiums due to these claims. James Dalton from the ABI has stated that the UK would win the Gold medal if whiplash claims were an Olympic event. He points out that claims management firms and lawyers are often helping claimants even when they have no real injury. He says that radical action is required and that a minimum speed threshold might be a good way to reduce the numbers. David Chandler developed asbestosis in 2007 due to his employment with Cape Building products between 1959 and 1962. It was ruled last year that the parent company of the now defunct Cape Building products was responsible for a compensation payment of £120,000 to Mr Chandler who now lives in Melbourne, Australia. The parent company challenged that ruling, this was overturned this week. The judge in the case said that this was the first case where the parent company was held liable and that the decision could be relevant in other cases. So far the bank has put aside £1.3 billion which has caused its profits to dip. Other banks including Royal Bank of Scotland and HSBC are expected to show in their profits reports that the PPI scandal has hit them hard. Despite this, the profits for Barclays have been better than predicted and overall the banking industry has seen a 16% increase in retail banking profits. The amount of money put aside for PPI claims is now £8.2 billion, which makes the PPI scandal three times larger than the endowment mortgage scandal and well on its way toward levelling with the £11.7 billion spent on paying pensions mis-selling compensation. In fact, this is more than the carrier is legally obliged to do. Virgin is required to give accommodation and meals to passengers until they are able to get them to their original destination, which in this case was Florida. Those passengers who were left waiting in Florida were also given hotel accommodation. The flight was required to head back to Gatwick after problems developed during the flight. The Airbus 330 dumped fuel before landing and the pilot ordered an evacuation of the passengers immediately upon landing.
