Bristol Water Pay Compensation for Asbestos Death of Worker [10th May 2012]
A woman from Somerset has been awarded £290,000 in compensation from her husband's former employer after he died of cancer which was associated with asbestos poisoning. David Bean had worked for Bristol Water as an engineer and was responsible for visiting pumping stations which were lagged with asbestos. He was given no safety equipment at the time, a situation which Bristol Water say they have now remedied. Mr bean left Bristol Water in 1992 and despite knowledge of the dangers of asbestos, he still received no safety equipment during his water pumping stations rounds. In 2010 he development mesothelioma - he died last year. Bristol Water have said that they have made a compensation payment because of Mr Beans historic exposure to asbestos and that in the 'modern times' stringent safety measures have been put in place. Pomeranz Haudek Grossman and Gross, who are based in New York are hoping to point out to investors that they can take advantage of Texan law which states that non-US residents can seek recovery. This is despite recent cases which denied foreigners this right. The disaster saw shares in BP fall by 50% after the oil spill and since then they have only recovered around half of that figure. It is estimated that billions was wiped off the value of pensions investments from the UK. Pomeranz believes that there could be a case for fraud, negligent misrepresentation and aiding and abetting under state law - particularly with regard to the failure of BP to clean up their act after other oil spills in 2005 and 2006. PCO's are compensation payments which take the form of one lump sum followed by regular payments on an ongoing basis to cover medical costs. In some cases these can continue throughout the lifetime of the victim. The ratings agency Moddy's has commented that the uncertainty of these payments put insurers at risk due to inflation in the same way that annuity underwriters are. It is thought this could lead to higher capital payments or insurers. In the past these types of compensation payments were passed to the annuity sector, but due to low interest rates these have become too expensive. David Williams from AXA has said that small insures who have a high exposure to personal injury claims could be in trouble - especially for those insurers which deal with motor insurance claims exclusively. It was found that the UK company sold the medicines in good faith and were not aware that the Canadian patent was invalid. It seems that Servier had patent rights on a drug used for treating hypertension and cardiac insufficiency. They had obtained an injunction for the High Court to prevent Apotex from selling the drug in the UK and had agreed to pay them compensation if it was later found that this injunction was incorrect. However when that injunction was lifted the compensation was not paid and Servier argued that the drug was in breach of Canadian law where it would have been manufactured.
