Liverpool is UK's Whiplash Claiming Capital [28th May 2012]
A study conducted by the Financial Times has revealed that Liverpool is the whiplash capital of the UK. In fact there has been one compensation claim for whiplash for every 50 residents of the city. Other parts of the UK where there are disproportionately more whiplash claims are Uxbridge and Oldham. London also fell into the bottom ten. These cities have compensation rates at 20 times the average. Insurers have suggested that this disparity could be a clear sign of fraudulent claims taking place in pockets of the UK. When it comes to the lowest number of whiplash claims, Scotland leads the board, mostly due to the stricter controls on the use of referral fees. In Edinburgh there were just 3 compensation cases for whiplash for every 1,000 residents. Dominic Clayden from Aviva has stated that he doubts that people in Scotland have stronger necks. The insurance industry are suggesting the claims management companies are going into deprived areas to take advantage of the financial needs of the people who live there. According to a study by the union which represents those doctors who have been accused of malpractice, one woman received £100,000 after having her uterus perforated and another woman received a similar amount after having a coil fitted even though she already had one in place. The study revealed that there have been 98 cases were GPs have been accused of malpractice involving IUD's since 2002 and most of these featured cases similar to those already mentioned. As a result of these findings the union will be issuing guidance to their members about fitting IUD's. They state that doctors should test for pregnancy first and ensure that a coil is not already in place. The sexual health charity FPA suggests that women check how well trained and experienced their doctor is before they agree to the procedure. She received £2800 in compensation from the Criminal Injuries Compensation Scheme. She has said that the compensation made her feel as though she was getting something back after weeks of pain. The campaign is being started by the Association of Personal Injury Lawyers and is hoping to change the government's mind about the proposal which will see an end to payments for less than £2500 and an reduction in payments of below £11,000. Harriet Riley was born at the Royal Gwent Hospital in Newport and cannot walk or talk due to the circumstances surrounding her birth. She will receive a £2 million lump sum payment plus £325,000 each year of her life so that she can have guaranteed care. In addition the NHS made an apology to her parents. The hospital has accepted that Harriet should have been delivered earlier and that some aspects of her care were not to the correct standard. The judge in the case stressed that the care and commitment shown by Harriet's parents was extraordinary.
