£3bn Maternity Compensation Bill for NHS [29th Oct 2012]
It has emerged that the NHS has paid out more than £3bn in compensation for maternity related claims between 2000 and 2010. In fact a report from the NHS Litigation Authority has stated that one in 1,000 births in the UK has resulted in a claim for compensation. The report has suggested that there needs to be better training and more senior staff available for women who are giving birth. The compensation claims for maternity cases are higher than in any other discipline and the claims are so high because in many cases it involves long term care payments for harmed children. Catherine Dixon from the Litigation Authority has commented that having a baby within the NHS is still very safe, however the claims made are very serious and they are aiming to improve clinical practice to prevent future cases. Meanwhile David Richmond from The Royal College of Obstetricians and Gynecologists has stated that the report should serve as a wake up call to anyone who has responsibilities in providing maternity care. He calls for urgent action. Richard Herman took the marketing company AAC to court after they refused to pay his invoice which charged them £10 for each minute of his time which was wasted. Mr Herman said that he felt oppressed by the company which was trying to encourage him to make a PPI related claim. It is thought that other individuals who want to do so could now take similar action against cold calling firms. Mr Herman is encouraging others to follow in his footsteps. As a telecommunications expert, he was able to record the calls made to his home number and used this as evidence to prove he been called and that he had warned them he would begin charging them for his time. He has now set up a website explaining how to make a claim against these companies. Scotland saw 4,955 claims in 2010/2011 which increased to 6,191 in 2011/2012. Patrick McGuire from the legal firm Thompson has commented that these claims could rise even higher as there were more than 10,000 reports of injuries in the workplace last year. He feels that it is a myth that many claims are spurious. He points out that many people in Scotland are employed in agriculture and construction - two areas where accidents are more common. The awards made for compensation range between £1,000 and £250,000 depending on the type of injury and psychological harm is also taken into account in these cases. The Association of Personal Injury Lawyers in Scotland has said that the knock on effect of higher claims should be improved health and safety and this is a good thing. The Surface was due to launch last week on the same day as the new Windows 8 operating system, however there appears to have been some confusion over when the tablet will arrive. Microsoft have said that emails were sent out telling customers that the tablet would arrive last week while the date is actually November 2. No reason has been given for the delay. The online voucher can be used for products such as apps and accessories from the online store.
