Fall Accident Injury
Statistics show that the most common accidents at work, at least for the construction industry, are falls from height. For all industries, injuries caused by workers falling or being hit by falling objects are all too common. The same is true in private life and public areas where fall accident injuries are by far the most frequent. People trip over raised paving slabs, stumble into potholes, slip on freshly washed floors or fall over trailing cables. There are so many potential causes of this type of accident, which often result in injuries serious enough to warrant claims for compensation. All occupiers of land and buildings have a duty of care towards people who use the premises, whether they are employees, customers, suppliers or visitors of any type. This duty of care means they have an obligation to ensure the premises are safe for anyone who enters them. The property occupiers can meet this duty of care by ensuring the premises are properly maintained and that adequate warnings are given of potential hazards. If a visitor slips on a wet floor that has recently been washed, they may have a compensation claim for any injuries they sustain. However, if signs and cones are set out to mark and warn of the dangers, then the duty of care is likely to be seen as having been fulfilled and a claim for negligence has less chance of success. Similarly, if there are no mats at the entrance to the building so that visitors can wipe their feet, wet floors may result from people bringing water in on their feet. An accident caused by slipping on the wet floors may then be due to a failure to exercise the correct duty of care. Injuries that result from falls in a person's own home are unlikely to be ones where compensation can be claimed. However, there are exceptions in property that is rented from a local authority or private landlord. An accident that is caused by a fault that the landlord is unaware of may not be grounds for a claim. But if the fault is reported and nothing is done to correct it, this may be considered negligence should an accident then occur. All compensation claims for injury will be treated on their merits. This will involve establishing not only whether there is a justifiable claim but also the amount of compensation that may be payable. |
