Slip Accident Injury
The term "slip injury" conjures up images of cracked paving slabs and icy pavements, but it could relate to all sorts of common and less common slips and trips. In most cases these sorts of accidents occur when proper maintenance of the pavement surface has been neglected. If this is the case then you may be entitled to claim compensation for any injury caused. If you have been injured when simply walking down the road you may wonder if you are able to claim compensation for your injury and what level of compensation are you likely to achieve. The first thing you will need to find out is whether your accident has occurred on a public highway. If the pavement or road is maintained at public expense then it is considered to be a public highway. You can even see a list of these areas at your council office. Your accident may have been caused by raised or cracked paving stones, road works which are not properly signposted, snow and ice which has not been cleared, spills which make the road surface slippery or work to the highway which has not be completed properly. If one of these circumstance has caused your injury then you may be able to claim compensation. The ease with which you will be able to win your case will be based on a number of factors. These could include how large and where the pavement defect was. For example a paving slab which is 2 inches higher than others, which is in front of a retirement village could be seen as being negligent. Small defects which are due to sub standard work will be easier to claim for and if previous complaints have been made, the courts may look more favourably on the case. Generally a solicitor will look at previous compensation claims to work out how much compensation you are entitled to. This is particularly true when it comes to pain and suffering as this is difficult to quantify. Other types of injury may have standard or set amounts which can be claimed. Those with facial injuries for example, can expect to receive anything from £1,500 up to £30,000 for serious jaw fractures. Permanent scarring can be even more than this. Claims will usually be worked out based on the amount of time a person has to take off work or how much the injury affects their quality of life. Claiming compensation not only helps you to recover from your injuries, but it will ensure that someone else does not suffer the same fate in the future. |
