Claim Compensation for a Work Related Back / Head Injury
Bank or head injury at work is a personal injury and such injury at work includes work-related illnesses such as a disease caused by working with chemicals. Immediate actions to be taken:- In case of an injury at work: > Record it in an accident book. If your workplace does not have an accident book, you should write out brief details of the accident and injuries, send them to your employer and keep a copy. > Gather evidence about the accident and injuries like taking photographs and making note of witnesses. > Report the injury to your doctor and seek medical advice. They may be contacted at advice [at] corporateaccountability.org Some routine accidents that cause back/head injury at work: Manual handling accident: The Manual Handling Operations Regulations 1992 (amended in 2002) are designed to protect employees from injuries caused by Manual Handling at work. The most common injury sustained by people carrying out manual handling at work is a back injury, although injuries to arms and feet are also fairly common. The Work at Height Regulations 2005 (amended in 2007) is intended to protect everyone who has to work at height. Working at "height" can apply to a person on a harness hundreds of feet above the ground painting a bridge for example and could also apply to a person standing on a chair in an office changing a light bulb. Making a complaint: • If you have suffered a back or head at injury at work, you may make a complaint. The complaint procedures are however time consuming and there are time limits for taking legal action. • All employers have a responsibility to protect their employees, contractors and visitors from accidents and injuries. So, if the accident at work that resulted in back or head injury was caused because of no fault of yours, you may be able to make a personal injury claim for compensation. You can also make a personal injury compensation claim if your workplace injury was caused by the negligence of another member of staff. In such a case, you would need to prove that the injury was caused as a result of the negligence of your employer or staff.
