Couple Awarded Compensation for Poor Standards [28th Jun 2012]
A couple have received a compensation payment of £10,000 after their dream holiday to the Maldives turned out to be a disaster. The pair were both taken ill during their time at the Summer Island Village Hotel after they contracted salmonella poisoning. They say the room was dirty and the food undercooked. In addition the water supply to their room was cut off and they could not use the toilet. The only time the couple were able to leave their room during the two week stay was to visit the hospital. The holiday company Cosmos have been told they must pay the compensation after it was found that the illnesses have had far more long reaching effects. Mr Beasant lost so much weight he could not try out as a professional sportsman which was his intention after the holiday. His wife was hoping to have IVF treatment, but has since conceived naturally. Cosmos Holidays have said that they have health and safety procedures in place and they ensure that the standards of each country's government are met. The Supreme Court ruled that Shaun Summers could keep almost £90,000 in compensation from Fairclough Homes after he suffered injuries when he slipped off a forklift truck step. His original claim was for £838,000 due to "life changing" injuries - these were later found to be faked. Fairclough's insurance company had filmed Mr Summers walking around without the crutches he had used when having his medical examination. Zurich have been arguing that Mr Summers should not be allowed to keep even a portion of the damages awarded because of the fraud. They have already taken the case to the Appeal Court and now the Supreme Court. The judge in this case has said that Mr Summers did suffer an injury due to the breach of duty of his employer and that it would not be fair to rule out a portion of the claim. Zurich point out that the deceit was substantial and Mr Summers even underwent a surgical procedure which was unnecessary. They say they will continue to fight similar cases. The relatives are claiming that the troops were not provided with the correct equipment to carry out their duties. The MoD are saying that the decisions surrounding equipment were made by the government and military commanders. A lawyer acting for the families has said that the state should be taking all reasonable measures to protect its soldiers and that regulations should be in place to ensure that adequate equipment and training are taking place. In particular, the families will be arguing about the use of Snatch Rovers which they say were not up to standard and that this was foreseeable. It has already been ruled that families can claim compensation under human rights laws, but as yet, claims under negligence legislation have not been agreed. Related Stories: Relatives of Iraq death soldiers make compensation bid - www.bbc.co.uk An employment tribunal in Manchester has ruled that the former staff of Focus DIY are able to ask for compensation after it was agreed that the store failed to inform the Unite union when the firm collapsed last year. 1,500 employees could receive as much as £2,500 each depending on their length of service, the size of the store and when they were made redundant. It is a legal requirement for the union to be informed when redundancies are likely and this did not happen in the case of Focus DIY. The union, Unite is now asking for former employees of the stores to get in touch to see if they are eligible for compensation. A spokesperson from the union has said that they will be able to put in claims for those people who worked in larger stores with more than 20 staff and the award will be 90 days pay.
