Car Accident Claims
Most car accidents in the UK result from driver error. This may be due to not looking properly when emerging at a junction or failing to maintain the prescribed stopping distance and colliding with the car in front. Whatever the cause, a car accident claim is possible if the accident is caused by someone else. If it's your fault, you can make no claim although there's obviously the possibility that someone may make a claim against you.Any claim will firstly seek to gain compensation for damage to your car and secondly for injuries to you as driver of the car and to any passengers travelling in the vehicle. The damage element is fairly straightforward because it's either the amount that's charged to repair the car or the cost of a replacement vehicle if the damage is so bad that the car is written off as beyond repair.
The amount for injuries is more complex to work out because it's a combination of many things. It seeks to compensate you and others for the pain you suffer, for reduced quality of life and the inability to do things you could do before the accident. It also aims to recover any losses you have incurred through additional expenses and loss of earnings that result from the injury.
All car drivers are legally obliged to have car insurance, with cover ranging from a comprehensive policy that effectively insures everything against most eventualities to third party cover, which at least provides for others involved in an accident. This means that any compensation you are awarded is paid by the offending driver's insurance company so that you don't have to be concerned about the person's resources or lack of them. The main worry is the large number of people who drive illegally without insurance. In these cases, you may have problems obtaining compensation from the offending party even if your claim is successful and you may have to rely on your own insurance company for the money. This will adversely affect your no claims discount and so will cause an increase in your future premiums, even though the accident was not your fault.
When an accident does occur, it's normally followed by a lot of confusion, especially if several vehicles are involved. It's important, therefore, that you keep a clear head and try to ascertain the facts as they happened. Try to write down as much as you can about what occurred, road and weather conditions and anything that's relevant. Take photographs to record the number and position of vehicles,
If the police do attend, details will be logged on the national database. Irrespective of this, you should try to get statements from any witnesses and record their contact details. Most importantly, exchange details, including insurance details, with all other drivers that are involved. The more information you have, the better the chances that your car insurance claim will succeed.
